New Asbestos Legislation

On 19 November 2025, the High Council issued positive recommendations on proposed updates to asbestos legislation.

A key part of the reform is a significant reduction in the exposure limit — from 0.1 fibres per cm³ to 0.01 by the end of 2025, and further to 0.002 by the end of 2029. The reform also tightens the “action value,” requiring companies to take preventive measures more quickly.

By the end of 2027, traditional optical microscopy will be replaced by scanning electron microscopy (SEM). The Council warns that laboratories will need sufficient time and resources to adapt, to avoid monopolies and higher costs.

The Council also emphasises the importance of high-quality training. Employers should demonstrate that workers have mastered the necessary skills — for basic tasks at least eight hours of training is recommended, with certification valid for one year.

Because these rules will apply to small businesses and self-employed individuals, simplifying administrative requirements and providing support are crucial to avoid overburdening smaller operators.

Respiratory protection is another focus: occupational physicians must assess whether workers are medically fit to use protective equipment. Terms such as “fit test” and “fit check” should be clearly defined to avoid confusion.

The Council further advocates for sustainable cooperation between asbestos removal companies and subcontractors to ensure consistent safety standards. Finally, the Council highlights the need for phased implementation. Stricter norms are essential for worker health, but companies, safety advisors, inspectors, and laboratories need time, clear guidance, and support to apply them in practice.
